Terms of Service

These Terms of Service (“Terms”) govern your use of the PlutoLinks platform, including the websites at plutolinks.com and mypluto.link, and all related services (the “Service”). PlutoLinks (“we,” “us,” or “our”) provides the Service to you (“you” or “User”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use PlutoLinks.

1. The Service

PlutoLinks provides tools for creating business pages and profile pages, capturing and managing leads, and automating customer communications using artificial intelligence. The Service is designed for small businesses and individuals who want an online presence without building a traditional website.

2. Your Account

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service. Notify us immediately at hello@plutolinks.com if you believe your account has been compromised.

3. AI-Generated Content

PlutoLinks uses artificial intelligence to generate automated responses to customer inquiries and follow-up communications on your behalf. By using these features, you acknowledge and agree that:

  • AI responses are automated and may be inaccurate. AI-generated content may contain errors, inaccuracies, or responses that do not perfectly reflect your business, services, pricing, or policies. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content.
  • You are responsible for AI communications sent on your behalf. While we strive to produce helpful and relevant replies, you are ultimately responsible for reviewing, managing, and correcting AI-generated messages. Any commitments, quotes, or representations made by the AI to your customers are your responsibility.
  • PlutoLinks is not liable for miscommunication. We are not responsible for any damages, losses, disputes, or misunderstandings that arise from AI-generated communications, including but not limited to incorrect pricing, inaccurate service descriptions, scheduling errors, or any other miscommunication between you and your customers.
  • AI follow-ups are automated. Automated follow-up messages are sent based on system logic and timing. We are not responsible for follow-ups that are sent at inappropriate times or that do not align with your preferences. You can disable or configure follow-up behavior in your dashboard.

4. Lead Data and Communications

By using the lead capture and management features, you agree that:

  • We do not guarantee lead quality or accuracy. PlutoLinks facilitates lead capture through contact forms on your page. We do not verify, validate, or guarantee the identity, legitimacy, or intent of individuals who submit inquiries.
  • We are not liable for missed or lost leads. While we make reasonable efforts to deliver all inquiries to your dashboard, we do not guarantee delivery of every submission. Technical issues, service interruptions, or other factors may result in missed leads. We are not responsible for any lost business opportunities.
  • Lead scoring is informational only. Lead quality scores and urgency levels are generated algorithmically and are provided as guidance, not guarantees. Business decisions should not be based solely on automated scoring.
  • You are responsible for your customer data. You must handle lead data in compliance with all applicable privacy laws and regulations in your jurisdiction. PlutoLinks provides the tools; how you use the data you collect is your responsibility.

5. Your Content

You retain ownership of all content you upload or create on PlutoLinks, including your business information, images, reviews, and profile data. By using the Service, you grant us a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of operating and providing the Service. This license ends when you delete your content or close your account.

You represent that you have the right to use all content you provide and that it does not infringe on any third party's rights.

6. User Responsibilities

You agree to:

  • Provide accurate and truthful business or profile information
  • Comply with all applicable laws and regulations in your jurisdiction
  • Not use the Service for any illegal or unauthorized purpose
  • Not misrepresent your identity, services, qualifications, or business
  • Not use the platform to send spam, harassing, or deceptive communications
  • Keep your business information, services, and pricing up to date

7. Pricing and Features

PlutoLinks is currently available free of charge during our early access period. You acknowledge and agree that:

  • Pricing is subject to change. We reserve the right to introduce paid plans, change pricing, or modify what is included in free and paid tiers at any time. We will make reasonable efforts to notify you in advance of material pricing changes.
  • Features may change. We continuously improve and evolve the platform. Features may be added, modified, or removed at any time. We do not guarantee that any specific feature will remain available.
  • Service availability is not guaranteed. While we strive for high uptime, we do not guarantee uninterrupted access to the Service. Scheduled maintenance, updates, and unforeseen issues may result in temporary downtime.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PlutoLinks and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Damages arising from AI-generated communications
  • Damages arising from missed, lost, or inaccurate leads
  • Damages arising from service interruptions or downtime
  • Any actions taken by your customers based on AI-generated content

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated content will be accurate.

10. Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or use the Service in a way that harms other users or the platform. Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we will make reasonable efforts to notify you via email or through the Service. Continued use of PlutoLinks after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Colorado.
